In keeping with the spirit of the big baseball game in Kansas City this week I thought this was an appropriate question.

Q:  My family and I went to a minor league baseball game here in town.  During the course of the game a player hit a foul ball and the ball hit my daughter right in the face.  The ball broke one of her teeth and bruised up her face badly.  I had to pay a $1000 deductable on my insurance to get her patched up.  Can I get that money from the team or the ballpark or even the player?

A:  In short, probably not.  You need to consult with a personal injury lawyer in your local area to get an answer 100% either way.  Usually, when you go to a ball game or a sporting event that has inherent dangers, like a baseball game, you assume the risk of damages due to that inherent danger.  If you go to a hockey game you probably bare the risk of getting hit by a puck, an arena football game you probably bare the risk of getting hit with a football.  You get the picture.  Additionally, if you look on the back of the ticket you will probably see a waiver of liability.  You’re not the first person to try and hold the team accountable for a foul ball, so they will usually have a damages waiver covering the ballpark and the team. That being said, you still need to contact a lawyer that specializes in personal injury to see if you have a case as all states have different laws on this particular subject.  Good luck.  Here is hoping it was a baby tooth and it will grow back!
