Ken Garten: What the heck is a registered agent?

The role of the registered agent in the law relates to the sacred and age-old concept of due process, without which government shall not deprive any party of life, liberty or property. Essential to that is the related concept of “notice and opportunity to be heard.” What that means, among many things, is that the government shall not permit a proceeding against any party in any manner such as a civil lawsuit to collect money damages, a tax dispute or the like without first there being assurance that the person or entity sought to be deprived had notice and opportunity to be heard so as to protect their rights, and that very specific rules regarding notice must be followed and observed in order to do so.
