A Blue Springs buffet restaurant has reached an agreement with the U.S. Department of Labor to resolve the restaurant’s violations of the Fair Labor Standards Act.

According to the Labor Department, Legend of Asia and manager Yu Mi Xiao failed to comply with the FLSA minimum wage, overtime and record-keeping provisions. As part of the agreement, 17 workers will receive a total of $150,000 – half for back wages and the other half for liquidated damages. The restaurant also must pay a civil penalty of $10,000 for willful violations.

Labor Department investigators had found the restaurant paid cooks a monthly salary and provided housing, meals and transportation, but given the work hours required their compensation did not equal at least minimum wage. The restaurant also did not pay overtime for workweeks greater than 40 hours and also failed to pay servers overtime.

Under terms of the consent agreement, which was entered in federal court in Kansas City, Legend of Asia will implement a computerized time-keeping system; have a third party audit time and payroll practices; provide payroll statements that clearly articulate the amount earned, as well as deductions; and provided training and notices for all employees regarding FLSA requirements.
